OVERVIEW
Please read these Terms of Service carefully before accessing or using our website.
By visiting this site and purchasing from us, you agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”). These Terms of Service apply to all users of the site, including without limitation customers, browsers, merchants. By accessing or using any part of the site, you agree to be bound by these Terms of Service.
We reserve our right to change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to review this page periodically for any changes.
STORE TERMS
By agreeing to the Terms of Service you represent that you are at least the age of majority in your state or that you are you have given / been given consent with regards any minor dependents making use this site.
Sabre sells non-firing replica / imitation guns / weapons strictly in adherence with any state or national laws and regulations governing the sale of replica weapons. For example, we will only sell and post replica pistols to Queensland and Western Australian customers without license permit as none is required. For South Australia we recommend you check with SAPOL, as whilst the type of replicas we sell should not require regulation based on advice received, SAPOL have recently indicated ambiguity over some models. For other States we we must sight the current membership for exemption (GIC in Victoria) permit or license of that State. NOTE: If a purchaser who lives in QLD or WA then moves interstate they will be required under the relevant laws of that state to acquire and hold a licence, permit, approval or exemption to possess a replica in that state.
If replicas are taken interstate into a state with laws that differ from QLD and WA you will be required to adhere to the laws of that State. NOTE: WE PLACE VERY CLEAR NOTICES IN THE REPLICA GUNS SECTION THAT WE CANNOT LEGALLY POST TO SOME STATES WITHOUT FIRST SEEING THE RIGHT PERMIT / EXEMPTION. WE RESERVE THE RIGHT TO DEDUCT ANY FEES THAT PAYPAL OR STRIPE CHARGE US FOR ANY CANCELLED ORDER RELATING TO A CUSTOMER IGNORING THESE NOTICES.
You must be over 18 before placing any order for replica guns or blades. If you are under 18 and / or falsely using a parent's card or Paypal identity this is a violation of our terms. By placing an order you certify that you are 18 years of age or over. For QLD customers we need to be emailed proof of over 18 before we can post blades or replica guns.
Sabre does not warrant nor represent that the products we sell are compliant with the laws in a particular state or territory. It is the purchaser’s responsibility to carefully consider the laws applicable to their circumstances prior to any purchase. To the extent permitted by law, Sabre disclaims all liability, howsoever arising, with respect to its customers’ compliance with applicable laws.
SABRE DOES NOT WARRANT THAT A PERSON MAY LEGALLY PURCHASE, POSSESS, OR CARRY ANY AND ALL ITEMS OFFERED ACCORDING TO FEDERAL, STATE, OR LOCAL LAWS. THESE ITEMS INCLUDE ALL THE PRODUCTS AVAILABLE FOR PURCHASE FROM OUR WEBSITE. WE BELIEVE IT IS EXTREMELY IMPORTANT TO COMPLY WITH FEDERAL, STATE AND LOCAL LAWS. BY PURCHASING ANY ITEM FROM US THE BUYER WARRANTS THAT HE / SHE IS IN COMPLIANCE WITH ALL FEDERAL, STATE AND LOCAL LAWS AND IS LEGALLY ABLE TO PURCHASE THESE ITEMS.
GENERAL CONDITIONS
We reserve the right to refuse service for any reason at any time.
Headings used in this agreement are used for convenience and will not limit or otherwise affect these Terms.
PRODUCTS OR SERVICES
We reserve our right to limit sales of products or services to any person, geographic region or jurisdiction. We reserve the right to limit the quantities of any products or services that we offer. Products or product pricing are subject to change at anytime without notice. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
PERSONAL INFORMATION
Your submission of personal information through the store is governed by our Privacy Policy.
DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
In no case shall our directors, officers, employees, affiliates, agents, contractors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any products procured from our store, or for any other claim related in any way to your use of the products, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the product.
INDEMNIFICATION
You agree to indemnify, defend and hold harmless our directors, employees, agents, contractors from any claim or demand, including legal fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the site, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Queensland Australia.
CHANGES TO TERMS OF SERVICE

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

Re-enactor, Veteran, Historical Member Discounts
Discounts on nominated items will occasionally be offered at our discretion for limited / timed promotions where evidence of membership to a legitimate living history body is provided (e.g. QLHF, Jeep Club etc) or letterhead from a veteran's body. Rates of discount and expiry of such offers are subject to change and will expire automatically 60 days from first date of publishing if not otherwise specified. Discounts cannot be applied to items that are already 'on sale'.
Genuine versus Reproductions
If an item is described as genuine it will be based upon our certainty of its provenance / and or having received trusted advice or certification to this effect from our network of militaria and military advisors (veterans, museum curators, historians, re-enactors, authors, collectors).
If we are not certain that an item is authentic or if it cannot be satisfactorily verified we will clearly say so.
We will also clearly describe replica / reproduction items.
When we are passing a customer on to an alliance partner of ours, then any terms of sale or returns policy are entirely between the customer and that alliance partner.
Selling Militaria To Us
Typically we will request clear images of an item be emailed to us, then agree a price and request the item to be sent to us (registered with tracking as per below) at owner's risk, and upon arrival and verification we will pay the agreed sales price.
If we agree to be sent a piece as part of a sale to us (or as an appraisal) we will request for it to be sent to us using Australia Post Registered Post with ID Required on delivery (or a mutually agreed similar service) and that tracking numbers be advised to us. This way both sender and receiver can track the item.
We accept no risk, responsibility or liability whatsoever for any such items sent to us until they are in our hands and we confirm their arrival in the condition shown to us in the images. For valuable items we recommend that the owner take any insurances they may deem to be required.
When sale items arrive and are verified as described / represented to us we then pay the agreed sales amount via PayPal or Bank Transfer. Should an item not be the agreed item / as pictured during the sales process we will return it to the seller.
Returns
REPLICA GUNS
Replica guns may be returned for exchange or refund if faulty from the manufacturer within 30 days. They will be examined and if there is clear evidence of rough and / or unreasonable treatment or usage of the item we reserve the right not to accept a return. Whilst these guns may look the same as the real weapons, they are not made from the same metal as real guns, and so cannot withstand unreasonably rough treatment and can break.
MILITARIA
Items owned by Sabre: If there is reasonable doubt on the authenticity of an item that has been described as genuine, irrespective of time, then we will also happily refund if the item is returned in the same condition that it was sold in. We offer money back assurance in such cases. You will be responsible for any costs and risks associated with returning the item to us including postage.
Items owned by an alliance partner: If Sabre is facilitating a connection between a valued customer and one of our high-end collectors, we do so in good faith, and if the final deal is to be concluded between the customer and that individual (or their entity) then reliance upon any certification and post-sale warranty will be entirely between those parties.
Shipping
We aim to ship within 24 hours, but are open about the fact that this is a professionally run venture, yet hobby level for us, so worst case scenario will be within 48 hours. Prices currently calculate postage for Australian addresses, and please contact us for outside of Australia so that we can calculate postage for you before purchase. We cannot send replica guns outside of Australia.
Notes on WW2 German / Third Reich Militaria
The sale, collecting and study of Nazi era militaria is surrounded by emotive controversy, and justifiably so, it was a turbulent era filled with reprehensible impacts upon humanity. As we will from time to time feature items from that era, here’s our take on this.
Australian military history has seen our troops confront many foes since the Boer War including South African Guerilla Forces, Imperial German, Turkish, Imperial Japanese, Italian Fascist, Nazi era German, Vietnamese forces etc.
As an historical aspect of WW2 Nazi era militaria is legitimately acquired and displayed by many national, Regimental and private museums worldwide to accurately reflect the military and political history of that era. It also keeps the memory of the era alive and makes it harder to deny its occurrence. In many cases the items are war trophies captured by allied soldiers, or used to powerfully illustrate the history and politics of that era, and highlight a defeated foe and ideology.
Many private collectors, especially those interested in WW2, will likewise have such items in their collections (many may be veteran bring backs from relatives who fought in North Africa).
Whilst the symbolism and history surrounding some items (or legitimate museum reproductions of such items) has dark history indeed, it does not make those who feature these items in a collection sympathetic to or condoning of the ideology or the politics from which they originate. If they are that way inclined, then that is well beyond the control of the seller, who in this case is selling such items as part of a general offering of military antiques and collectibles. With many of us and our connections having military and / or Police backgrounds, were we to actually suspect that a person has dangerous extremist tendencies then we'd do what any sensible business should do and report the matter to the Federal Police.
Some will sadly seek to label collectors. It is unfair in our opinion to accuse militaria sellers or collectors as extremists or supporters of extremism just because they collect WW2 items, some of which may be from the enemy side of WW2. The collecting and study of enemy Japanese Imperial items such as Katanas doesn't seem to attract such venom, yet their atrocities are of course numerous (for example the rape of Nanking and diabolical treatment of Allied POW's). Once again, most often such items were brought to Australia as war trophies that symbolised a defeated enemy.
Many such collectors are be either former members of the ADF, who at some stage of their life actually volunteered to fight such ideologies should they re-emerge, or are descendants of those who actually did. This makes such accusations not only highly offensive, but could also be taken as written or verbal defamation if unfounded and directed at an individual or especially at a business.
If we do from time to time have WW2 German era militaria for sale the spirit in which we offer this for display and sale is purely as part of the legitimate hobby of collecting military antiques from all eras, and that includes WW2.
No offence is ever intended and there are no political or revisionist statements being made. We feel that it is a legitimate aspect of the general collecting and preservation of military history be it as a war trophy item, or as part of the legitimate study and collecting of wartime artefacts from all eras and nationalities.
To us it's history, and to erase or selectively delete aspects of military history is to risk repeating it. To accuse sellers and collectors of political intent and failing to see that there are other sides to the story and nuance to the issues around the acquisition of WW2 items is also problematic we feel.
Our trade in all militaria is purely with the intent of supporting private and public museums, collectors and historians in the context of educational purposes, preservation, research and study. We in now way support or condone extremism or propaganda for extremist causes.
